Please read these Terms of Use carefully before using the Valp DA website or enrolling in any of our nature forest education programs.

1. Acceptance of Terms

By accessing or using the Valp DA website (the "Website"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the Website.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Valp DA ("we", "us", or "our"), a business registered at Gyldenløves gate 19A, 7043 Trondheim, Norway.

You must be at least 16 years of age to use this Website independently. If you are under 16, you may only access the Website under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Your continued use of the Website after any changes to these Terms constitutes acceptance of those changes. We encourage you to review these Terms periodically.

Valp DA operates an educational platform focused on nature forest education, outdoor awareness, forest learning, environmental literacy, seasonal nature observation, wildlife awareness, responsible outdoor habits, and beginner-friendly nature skills for learners throughout Canada.

Our services include, but are not limited to:

  • Online nature forest education programs of varying duration and focus
  • Educational materials including observation guides, seasonal checklists, and preparation resources
  • Forest awareness and environmental responsibility content
  • Family-friendly outdoor learning pathways
  • Nature observation skills training delivered through structured online modules
  • Educational gallery content showcasing Canadian forest landscapes

All programs and materials are provided for educational and informational purposes only. We do not provide medical advice, legal advice, survival training, professional certification leading to employment, or guaranteed safety outcomes of any kind.

The scope, availability, format, and content of our programs may change at our discretion. We will make reasonable efforts to communicate material changes through the Website, but we are not obligated to maintain any specific program indefinitely.

3. User Obligations

When using this Website, you agree to the following obligations:

  • You will use the Website only for lawful purposes and in accordance with these Terms.
  • You will not attempt to gain unauthorized access to any part of the Website, its servers, or any connected systems.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its content for personal, non-commercial educational purposes only. This license does not include the right to:

  • Reproduce or copy the content for commercial purposes

  • Distribute, sell, license, or transfer the content to third parties

The Website and all content, services, and educational materials provided through it are offered on an "as is" and "as available" basis without any warranties of any kind, whether express or implied.

Valp DA specifically disclaims the following:

  • No warranty of accuracy: While we make reasonable efforts to ensure the educational content is accurate and current, we do not warrant or guarantee the completeness, reliability, or accuracy of any information on the Website.
  • No warranty of availability: We do not guarantee that the Website will be available at all times, uninterrupted, or free from errors or technical issues.
  • No warranty of fitness for purpose: Our educational materials are general in nature and may not be suitable for your specific situation, location, or learning objectives.
  • No safety guarantees: Educational materials do not guarantee safety, survival outcomes, weather protection, risk-free outdoor activity, or protection from wildlife encounters.
  • No health or medical claims: Nothing on the Website should be interpreted as medical, health, or therapeutic advice.
  • No professional certification guarantees: Completion certificates, where offered, confirm course completion only and do not constitute professional qualifications, licences, or credentials recognized by any regulatory body.
  • No employment guarantees: Our programs do not guarantee employment, career advancement, or professional opportunities.

Participants remain fully responsible for their own outdoor decisions, physical limitations, local regulations, weather conditions, route choices, equipment selection, safety planning, environmental behaviour, and the practical application of any educational materials provided through the Website.

6. Limitation of Liability

To the fullest extent permitted by Norwegian law, Valp DA, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or anticipated savings
  • Loss of data or information
  • Personal injury or property damage resulting from the application of educational content
  • Any interruption or cessation of access to the Website
  • Any errors, inaccuracies, or omissions in the content
  • Any unauthorized access to or use of our servers or personal information

In any event, our total aggregate liability for all claims arising out of or relating to your use of the Website or our services shall not exceed the amount you have paid to Valp DA in the twelve (12) months immediately preceding the event giving rise to the claim, or NOK 5,000 (five thousand Norwegian Kroner), whichever is greater.

This limitation of liability applies regardless of the legal theory under which the claim is brought, including breach of contract, tort (including negligence), strict liability, or any other basis, even if Valp DA has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Valp DA, its directors, employees, partners, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Website or our educational services
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or the rights of any third party
  • Any content or information you submit through the Website
  • Your application of educational materials in outdoor settings or any other context
  • Any claim by a third party that your actions related to our services caused them damage

This indemnification obligation survives the termination of these Terms and your use of the Website.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Norway, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website that cannot be resolved through the informal dispute resolution process described in Section 11 below shall be subject to the exclusive jurisdiction of the courts of Trondheim, Norway (Trøndelag tingrett).

If you are a consumer residing in the European Economic Area, you retain any mandatory consumer protection rights afforded to you under the laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer under applicable Norwegian or EEA consumer protection legislation.

11. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or your use of the Website, you agree to first attempt to resolve the dispute informally by contacting us at [email protected].

We will make good-faith efforts to resolve any dispute within 30 days of receiving your written notice. Your notice should include a clear description of the dispute, any relevant supporting information, and the resolution you are seeking.

If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of Trondheim, Norway, as specified in Section 10.

For consumers in the European Economic Area, you may also have the option to submit a complaint through the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Norwegian consumers may also contact the Norwegian Consumer Authority (Forbrukertilsynet) for guidance.

12. Termination

We reserve the right to suspend or terminate your access to the Website and our services at any time, with or without cause, with or without notice, if we reasonably believe that:

  • You have violated any provision of these Terms
  • Your use of the Website poses a security risk or may cause harm to other users
  • Your use of the Website may subject Valp DA to legal liability
  • Your account or usage patterns suggest fraudulent, abusive, or unauthorized activity
  • Continued provision of the service to you is no longer commercially viable

All nature forest programs, outdoor awareness lessons, environmental learning materials, checklists, workshops, downloadable resources, gallery examples, and educational content available through the Website are provided solely for educational and informational purposes.

The Website does not provide and should not be relied upon for:
